Please read these Terms carefully. They set out the basis upon which you will be provided with treatment at our Ophthalmology Clinics.
Newmedica may update these Terms from time to time. However, changes to these Terms will only apply to any new episode of Care or Treatment that you receive, and you will be asked to agree to any new Terms before they become applicable to you. New Terms will not apply to a Treatment which is part-way through when the Terms are changed.
If you want to check how much something costs, please ask the Ophthalmology Clinic, either by phone or in person. You can also ask for a copy of Newmedica’s Private Treatment Price Guide when you are at an Ophthalmology Clinic. Please ask us if there is something that you would like explained further before you sign these Terms
‘Applicable Law’ means any and all laws, regulations, guidelines and professional obligations applicable to the provision of Care or the performance of services for you, including the requirements as regards to treatment, procurement, research and storage of reproductive material;
‘Care’ means care, treatment, diagnosis, services and goods provided by us;
‘Consultants’ means all consultants, surgeons and anaesthetists involved in your Care;
‘Contract’ means these Terms and, if applicable, your Treatment Letter;
‘Newmedica’, ‘we’ or ‘us’ means New Medical Systems Limited (trading as ‘Newmedica’) where the Ophthalmology Clinic in which you receive your Care is operated by a member of the Newmedica Group;
‘Newmedica Group’ means New Medical Systems Limited (trading as ‘Newmedica’), together with its holding companies, its subsidiaries and any subsidiaries of its holding companies; ‘Newmedica Standard Rates’ means the Newmedica standard rates for Care, a copy of which can be obtained from an Ophthalmology Clinic upon request;
‘NHS’ means National Health Service;
Newmedica Group Ophthalmology Clinic or a clinic where Care is administered;
‘Package Price’ means how much you will pay for cataract Care, as set out in your Treatment Letter;
‘Private Patients’ means all patients who are not NHS patients and includes patients who are covered by medical insurance and patients who are paying for their own Care;
‘Terms’ means these terms and conditions; and
‘Treatment Letter’ means the letter that we send to you (if applicable) regarding your treatment or Care.
This section will apply if you are covered by private medical insurance:
1. You agree to pay for your Care
2. While you remain responsible for the payment of your Care, where you have private medical insurance:
(a) we will, where possible, process the insurance claim for your Care with your insurer, provided you have given us and your insurer all the information required to do so. If this information is incomplete or inaccurate, we may not be able to process your claim and you will need to pay for you;
(b) where we process your insurance claim and your insurer pays us direct, the rate agreed between Newmedica and your insurer (rather than the Newmedica Standard Rates) will apply to your Care;
(c) if your insurer fails to settle our invoices (or any part of them) within 90 days of the date of issue of the invoice, we will assume that the outstanding amount will not be paid by your insurer and we will invoice you for the balance due;
(d) if we invoice you for your Care or an element of your Care, you agree to pay us the amount invoiced within the time limits set out on the invoice. If you believe your invoice is incorrect, please let us know as soon as possible; and
(e) if your insurer only covers part of your Care, you agree to pay us the amount not covered by your insurance in advance of your Care. Funds need to be cleared prior to surgery otherwise surgery may be postponed or cancelled and you will be liable for any cancellation fees.
3. It is your responsibility to confirm with your insurer in advance that your Care is covered by your insurance policy as Newmedica will not obtain any such confirmation on your behalf.
4. If you are required to pay an insurance excess amount, you will pay this to Newmedica directly. The excess amount is usually notified by insurers to Newmedica following surgery. You can contact your insurer direct to find out how much the excess will be.
5. Some insurers use Care guidelines that may not match the professional medical opinion of the Consultants, nursing staff and other medical professionals providing your Care. In some cases, this can mean that your insurer may not pay for certain parts of the Care you receive, and you will be required to pay for that part of your Care. In particular, you should note that treatment for complications may in some cases not be covered by insurance, and in such cases you agree to cover the cost of your Care as set out in paragraph 2(c) & 2(e) above.
6. Please note that your insurance policy may not cover the cost of items such as specialist equipment, or it may only cover part of such costs. You will be required to pay for any such items not reimbursed by your insurer.
7. In the absence of an agreed rate, if you pay for your Care and subsequently seek reimbursement from your insurer, the Newmedica Standard Rates will apply.
8. If no rate has been agreed between Newmedica and your insurer in respect of your Care, the Newmedica Standard Rates will apply to your Care.
This section will apply if you are receiving cataract Care and are not relying on medical insurance:
9. You will have been sent a Treatment Letter which forms part of your contract with Newmedica which will confirm your procedure, the associated price and how you pay. Please ensure you read the Treatment Letter carefully.
What is included in the Package Price?
10. Your Treatment Letter will confirm the Package Price for your Care that you are to receive under your treatment. Unless your Treatment Letter says otherwise, your Package Price in relation to your procedure includes: (a) Consultants’ fees for your procedure; (b) your nursing Care, including while you are in the Ophthalmology Clinic and post-discharge follow-up appointment(s); (d) operating theatre charges; (e) all tests to determine your fitness for surgery immediately pre-admission; (f) all tests, treatments, drugs and dressings you may need during your treatment at the Ophthalmology Clinic; (g) your essential medical or surgical equipment; (h) all implants typically used for the procedure that you are having; (i) all take-home drugs that you require on the advice of or as prescribed by your Consultant for up to four (4) weeks following discharge; (j) clinically necessary follow-up appointments, related to a cataract procedure, with your Consultant; (k) all clinically necessary post-discharge scans, related to your procedure; and (l) treatment for any clinical complications, subject to paragraph 15 below.
What is not included in the Package Price?
11. The following items are not included in your Package Price. If you have not paid for these already, you will be asked to pay for these separately at the Newmedica Standard Rates (unless otherwise stated in your Treatment Letter). The items not included in your Package Price are: (a) Care not listed in paragraph 9 above or Care listed in your Treatment Letter as being excluded from your Treatment; (b) Care that you receive anywhere other than at the Ophthalmology Clinic or affiliated optical centre as part of a co managed pathway, where you have booked your treatment; and (c) Care you receive that is not related to the condition that is being treated by the Ophthalmology Clinic, such as for a pre-existing condition.
What happens if you decide not to go ahead?
12. If your treatment includes special order intraocular lenses (IOLs) you may be required to pay a deposit of £500 prior to your treatment. If you decide not to go ahead with your Care, you may lose the prepaid deposit which will cover the cost of the IOLs that were ordered specifically for your procedure. In addition, we reserve the right to charge a discretionary cancellation fee in accordance with paragraph 21 below if you cancel your treatment within seven (7) days of a scheduled appointment or admission date.
13. If you have already paid for your procedure, we will refund your payment, less any amount that you owe to the Ophthalmology Clinic and/or the Consultant under paragraph 11 above or paragraph 21 below. Please note that we will pay any refund (by cheque or electronic transfer) only to the cardholder or person who made the original payment. We do not pay cash refunds. Newmedica Private Patient Terms & Conditions Please read these Terms carefully. They set out the basis upon which you will be provided with treatment at our Ophthalmology Clinics.
14. Please note that if your Consultant cancels your procedure because they consider it is not in your best interests for medical reasons, and you have already paid for your procedure, we will refund your entire payment. You will not be required to pay for any Care included in your Treatment that you have received up until the point of such cancellation
What happens if you suffer complications?
15. While the Ophthalmology Clinic team and your Consultant will do their best to ensure a satisfactory outcome, no clinical procedure is entirely risk-free and the results of any particular treatment cannot be guaranteed with complete certainty. If you are unsure of the risks related to the procedure you have elected to have, you should not proceed with the Care proposed. By signing the consent form you are agreeing that the risks and benefits of your procedure have been made clear to you and you accept to proceed with the Care proposed to you knowing the risks and benefits. If you have any concerns, you should discuss these with your Consultant before deciding to proceed with the Care.
16. Your Package Price includes the cost of treating you at a Newmedica Ophthalmology Clinic and any clinical complications identified by your Consultant arising directly out of the treatment you receive as part of your procedure or Care (provided that you have followed the advice of your Consultant and any other medical professionals involved in your Care). Treatment for clinical complications includes any consultations, out patient and day-case treatment which your Consultant determines you need within six (6) months of the date of your initial treatment and which the Ophthalmology Clinic is able to provide you. If we are unable to re-admit you to the same Ophthalmology Clinic we will make appropriate alternative arrangements at another Ophthalmology Clinic at no additional cost to you.
17. If you require transfer to an NHS facility or a non-Newmedica facility due to complications as a result of your procedure, we will support the referral process required to affect such a transfer.
Section 3 – Self-Pay:
This section will apply if you are paying for your own Care which is not part of a Package Price for cataract surgery:
18. Ophthalmology Clinic will give you an estimate of costs for your Care. Please note that it is not always possible to give an exact estimate for the Care you receive at the Ophthalmology Clinic and the total cost may depend on a number of factors, including any other conditions you may have. The Ophthalmology Clinic will always try to provide an accurate estimate and if the cost of your Care is likely to exceed this estimate the Ophthalmology Clinic will try to notify you as soon as possible. If your Care is not paid for by an insurer directly, is not covered by a Package Price, or is to be paid by you in accordance with these Terms, you will be charged at Newmedica Standard Rates and your Treatment Letter (if relevant and in so far as possible) will confirm this. Note that this includes treatment for clinical or other complications which, if needed, will also be charged to you at Newmedica Standard Rates.
19. The Ophthalmology Clinic will give you an estimate of costs for your Care. Please note that it is not always possible to give an exact estimate for the Care you receive at the Ophthalmology Clinic and the total cost may depend on a number of factors, including any other conditions you may have. The Ophthalmology Clinic will always try to provide an accurate estimate and if the cost of your Care is likely to exceed this estimate the Ophthalmology Clinic will try to notify you as soon as possible. You are responsible for the payment of all Care you receive at the Ophthalmology Clinic.
20. You will need to pay for your Care prior to your treatment.
Section 4 - Other Terms and Conditions:
This section applies to all Private Patients:
21. Consultants: The Consultant will be responsible for the Care he/she gives you (subject to limitations below). (a) Although you will be under the Care of your named Consultant, other Consultants may also be involved in your Care as appropriate. Newmedica staff, including nurses, will provide your Care under your Consultant’s instructions. (b) Consultants involved in your Care may be independent practitioners or employees of the Ophthalmology Clinic. Accordingly, Newmedica will not be liable for any act or omission of a Consultant (or the company or partnership that employs or engages the Consultants) that is not an employee of Newmedica.
22. Cancellations: We reserve the right to charge a cancellation fee if you cancel any appointment with Newmedica within seven (7) days of your scheduled appointment or admission date. A cancellation fee may be based on any Care that you have received up to the point of cancellation and/or any other reasonable costs that the Ophthalmology Clinic has incurred.
23. Credit/Debit Card: You are responsible for settling the cost of your Care prior to your treatment.
24. Your Contract with Newmedica: By signing these Terms, you agree to be bound by these terms and conditions. If there is any conflict between these Terms and the Treatment Letter, these Terms will take precedence. If there is any inconsistency between the Contract and any marketing material, the Contract will take precedence.
25. Newmedica Standard Rates: Unless the Terms or your Treatment Letter (if applicable) provide otherwise, the Newmedica Standard Rates will apply to your Care. If you want to check how much something costs, please ask. You can ask for a copy of Newmedica Standard Rates when you are at any Ophthalmology Clinic or by phoning your local Ophthalmology Clinic.
26. Your data: For information on how Newmedica uses your data, please refer to our Privacy Notice on our website at newmedica.co.uk/ privacy-notice/
27. Notices and your contact details: It is important that you keep us updated of any changes in your contact details.
28. Your property: Ophthalmology Clinics can be busy environments. While we will take all care to ensure the safety of your belongings, Newmedica does not accept any responsibility for the theft or loss of, or damage to, any property belonging to you or your visitors.
29. Changes in Applicable Law: You acknowledge and accept that Applicable Law may change and prevent Newmedica from providing certain Care. If Newmedica becomes aware that such a change has occurred, and the change has an effect on your Care, Newmedica will contact you to inform you of this and its consequences.
30. Assignment: Newmedica may transfer and assign your Contract to any person who acquires all or substantially all of the assets of Newmedica or to any other member of the Newmedica Group.
31. Third Party Rights: Except for you or Newmedica, no person will have any rights under or in connection with these Terms.
32. Law and the Courts: These Terms are governed by and shall be construed in accordance with English law and the courts of England and Wales shall have non exclusive jurisdiction. Newmedica and their associated logos are trademarks of New Medical Systems Limited.
